Wal-Mart To Include Birth Control In Employee Health Insurance Coverage Plan Beginning Jan. 1

Wal-Mart Stores on Thursday announced that the company for the first time will include coverage for prescription contraceptives in its basic employee health plan beginning Jan. 1, 2007, the Arkansas Democrat-Gazette reports. The announcement resulted in the dismissal of a class-action lawsuit filed in federal court five years ago by a Wal-Mart customer service manager (Painter, Arkansas Democrat-Gazette, 12/22). The suit, which was filed in federal court in Atlanta, said that Wal-Mart discriminated against female employees by not offering coverage for prescription contraceptives. The suit sought reimbursement for all employees who paid for their own prescription contraceptives during the two years preceding the suit (Kaiser Daily Women’s Health Policy Report, 10/17/2001). According to Wal-Mart spokesperson John Simley, the decision to include contraceptives in the company’s insurance plan was made separately from the suit. “This is a regular part of the basic health care plan,” Simley said, adding that he is not aware of any potential cost increases because of the decision. According to Marcia Greenberger, co-president of the National Women’s Law Center, it is significant that Wal-Mart plans to cover prescription birth control. “We recognize that their (health care) plan is not a strong plan,” Greenberger said, adding, “But they have at least taken the proper step of recognizing that for women, contraceptives are an important part of their health care.” Milberg Weiss Bershad Hynes & Lerach — the law firm that served as lead counsel on the suit — declined to comment on the case. As of January 2006, Wal-Mart employed 1.34 million workers in the U.S., and a 2005 federal report found that 60.5% of the company’s employees are women (Arkansas Democrat-Gazette, 12/22).
