Coach guilty of some sex assault charges

A DuPage County jury this afternoon convicted Hinsdale Central basketball coach Robert J. Mueller Jr., on eight of the 21 sex assault counts against him.Jurors deliberated for 14 hours during a two-day span. Mueller is convicted of having sex with two underage students.
He faces between four and 15 years in prison, possibly more depending on how the sentencing is carried out. Mueller’s bond was immediately revoked, and he was taken into custody.
His wife Paula was denied a goodbye hug and said “I love you†to her husband as he was taken away. She burst into tears, as did other family members who have stood by Mueller during the trial.
The jury of five women and seven men waded through weeks of evidence, including testimony from nearly 70 witnesses.

Mueller denied any inappropriate contact with one of the students. He acknowledged having an affair with the other girl, a champion athlete, but he said it did not begin until after she turned 18, the legal age, and after her 2001 graduation.
At the trial’s onset, one of the girls tearfully testified she at age 15 began having weekly sex with him in his car and the high school in 2002. She said the sex continued through early 2004 until police received an anonymous letter about them.
Mueller, 45, of Woodridge, was arrested weeks later, and the school district placed the nearly 20-year science teacher on unpaid leave. A grand jury later indicted him on allegations involving the earlier affair with the athlete.
Though Mueller said she was 18, the girl testified she is certain they first had sex when she was 16 on Dec. 14, 1999. She said they had sex once to twice a week, usually in his car, but at least once in the school. The affair lasted until January 2002, she said, into her freshman year in college.
The defense team, Jack Donahue and Daniel Brown, called nearly 50 teachers, coaches, staff and former players to testify they never saw Mueller act inappropriately.
Donahue said Mueller was guilty of using “abysmal judgment†in having the affair, but he argues the girl was 18 so it was not illegal. He denied the other accuser’s claims, which he said were born out of a young, troubled girl’s attempt to gain attention.
“He may be an adulterer, but he’s not a predator,†Donahue told jurors during closing arguments. “He’s a good man who has basically sinned and, as the lies spread, he became encapsulated in them, but he’s not a criminal.â€
Donahue argued prosecutors lacked physical evidence, medical testimony, solid corroborative witnesses, or a confession. He noted inconsistencies in the girls’ testimonies and that their accounts of what happened evolved with time.
But prosecutors Alex McGimpsey and Tim Diamond said neither girl had a motive to lie about such a private thing. In fact, both initially denied it. They don’t even know each other. Both described similar sexual trysts, such as in his car while it was in secluded parking lots. Each knew he had a vasectomy.
Though the girls couldn’t always recall exact dates, they were resolute about their sexual relationship with the coach.
No one ever saw Mueller having sex with either girl, but four of their friends testified they often confided to them about it. Two other students also saw the younger girl straddling a bald man who resembled Mueller in a car similar to his in an apartment lot. And another student testified she saw Mueller pat the girl’s buttocks in class.
Mueller, at one point an assistant athletic director, also testified during the trial. He remained composed while McGimpsey upon cross-examination portrayed him as a liar whose explanations were too convenient.
For example, Mueller admitted to police that he drove the younger girl home about 20 times but he never told them the two ever stopped to talk in secluded areas of apartment parking lots. He also didn’t mention the earlier affair with the athlete.
McGimpsey disputed the idea the younger girl made up the trysts to get attention.
